Article 169
Vacancy of the post of Chief Minister and Minister

(1) The post of Chief Minister shall be vacant in any of the following cases:-
(a) If he resigns in writing to the Head of the State,
(b) If the motion of confidence cannot be passed in accordance with Article 188 or if the motion of no confidence is passed against him,
(c) If he is not a member of the State Assembly,
(d) In case of his death.
(2) The post of Minister shall be vacant in any of the following cases:-
(a) If he tenders his resignation in writing to the Chief Minister,
(b) If the Chief Minister dismisses him,
(c) If the post of Chief Minister becomes vacant as per clause (a), (b) or (c) of sub-section (1),
(d) In case of his death.
(3) Even if the post of Chief Minister is vacant according to sub-section (1), the same Council of Ministers shall carry out the work until another Provincial Council of Ministers is formed. But in case of the death of the Chief Minister, the most senior minister will act as the Chief Minister until another Chief Minister is appointed.
